Personal Injury/Wrongful Death

personal injury pencilMany aspects of family law affect families—divorce, child custody, real estate, finance, property, taxes, trusts and estates to name a few. Perhaps the event with the greatest potential impact on a family, however, is the injury or death of a loved one.

A serious personal injury can permanently alter a person’s life and the life of a family. The injury or death of a child can be especially devastating. Personal injury victims and their families often must cope with debilitating injuries, substantial medical expenses, emotional suffering, and lost earnings. Some personal injury victims become permanently disabled and can never work again.

When there is a personal injury or wrongful death in a family, the tragedy is compounded by knowing someone or something was at fault. It also can be particularly difficult for family members to heal, rebuild, and move on with their lives. “Accidents” many times are in name only. Labeling events “accidents” does not mean those who may be responsible for a family member’s injury or death should not be held accountable.

If an injury or death was caused by the fault, wrongdoing, or negligence of another person or company, the victim may bring a lawsuit against the responsible person or company in order to secure justice, compensation, and peace of mind. Personal injury and wrongful death lawsuits cover a broad list of situations, including:

  • Motor vehicle accidents. Car wrecks, 18-wheeler accidents, bus accidents, motorcycle accidents, ATV accidents,airplane/helicopter crashes, and accidents involving pedestrians, bicyclists, drunk drivers, boats and other watercraft.
  • Workplace accidents. Scaffolding and ladder falls, falling debris, explosions, burns, asbestos and mesothelioma, benzene, butadiene and other chemical exposure, offshore injuries, maritime accidents, and accidents involving defective tools, machinery, and equipment.
  • Dangerous products. Defective toys, tires, lawn equipment, food products, and other defectively designed products, defectively manufactured products, and products failing to provide adequate warnings or instructions about their proper use.
  • Harmful drugs and medical devices. Accutane, Actos, Androgel, Avandia, Chantix, Darvon, Darvocet, Depakote, Dilantin, Fosamax, Ortho Evra, Paxil, Pradaxa, Risperdal, Testosterone Replacement Therapy, Topamax, Yaz/Yasmin, and Zoloft. Transvaginal Mesh, Stryker Hip Implants, GranuFlo and NaturaLyte.
  • Premises liability. Slip-and-fall accidents, assault, dog bites and other animal attacks, negligent security, defective playground equipment, nursing home abuse, and child sex abuse.
  • Medical malpractice. Brain injuries, birth injuries, failure to diagnose, misdiagnoses, surgical errors, and prescription drug errors.
